Below you will find all the information that you should know about our policies; and, since they contain legal obligations, we request you to read them carefully, as they are the basis for the acceptance of reservations by LIMA BIKE GUIDE S.A.C.

LIMA BIKE GUIDE S.A.C., from now on THE COMPANY, through its website (www.limabikeguide.com), offers a variety of guided bike tours in Lima city. By making a reservation with the company, through its website or any affiliated page, it is considered that the customer has accepted these terms and conditions on behalf of all individuals included in the reservation. The company may modify these terms and conditions at any time publishing online this information online; please review these terms and conditions periodically to assure you are aware of the changes made by the company.

The use of www.limabikeguide.com and any affiliated website is designed for personal and non-commercial use, or to make legitimate requests for booking the services offered. The user agrees not to use this website or those of its affiliates to make speculative, false or fraudulent requests. Also, the user may not reproduce, copy, download, publish, transmit, divulge, or use in any other way the contents of this website or those of its affiliates (including texts, images, URLs, price information, etc.) under any concept, except for your personal and non-commercial use. Any other use of content belonging to the company or its affiliates requires the previous explicit written consent of LIMA BIKE GUIDE S.A.C. Likewise, the user agrees to use this website and those of its affiliate, only for legitimate purposes that do not infringe third parties rights and that do not obstruct or interfere with the use of this website for other users.

 

PRICES:

  • Tour prices: Published prices in our website and those of our affiliate, are the right price when making the reservation.
  • Price change: Published prices in our website are the current prices and they can change without prior notice. Once a customer has made a reservation, he/she will not be asked to pay any difference if a price increase takes place. The company will not make refunds if a price reduction occurs.
  • Child fare: Children from 1 to 4 years old (with a maximum weight of 17 kilos) can join the tour at no cost, as long as they do not exceed the maximum allowed capacity of the baby seat. Children 5 years or older pay the regular fare.
  • Per person: All published prices are per person, unless stated otherwise.
  • Inclusions: Prices include all the details indicated in each tour description.
  • Exclusions: Prices do not include tips. If you are pleased with the service provided by your guide, a tip, although not mandatory, is always pleasantly accepted and appreciated.

 

PAYMENT:

  • Currencies accepted: Our tour prices are published in US dollars. Other currencies may only be available when the financial institution issuing the payment card allows it, in accordance with the currency conversion policies of that financial institution.
  • In our website we accept Visa, Mastercard, American Express and Diners Club credit or debit cards as payment methods, through CULQI (www.culqi.com) payment service; also through PayPal and our local bank account in US dollars in the BBVA Banco Continental.
  • We guarantee final prices shown in our website will always be the amounts to be charged to the bank issuing the credit or debit card. There will be no additional charge or commission for processing credit or debit card payments.

 

CANCELLATIONS, NON-ATTENDANCES AND AMENDMENTS:

  • We offer 100% refund of the reservation, as long as it is canceled with a minimum of 72 hours (3 days) in advance of the day of the tour. Unfortunately, we are not able to make any refund within 72 hours (3 days) prior to the day of the tour. Also, in case of not showing up at the date and time of the tour booked, no refund will be issued nor will the date or time be rescheduled.
  • To request a reservation cancellation, contact us at info@limabikeguide.com with your request and reservation number; and, if it complies with the cancellation policy, we will proceed to refund the reservation, through a refund order for the amount charged to the payment card’s associated account with which the payment was made in our website. The refund takes around 5 business days to appear in the customer's account. Any delay beyond this period is strictly related to the speed of transaction processing of the customer's bank.
  • If you require to change the date or the schedule of your reservation, there is no penalty, just contact us at info@limabikeguide.com as soon as possible, to confirm the availability of the new date or schedule required.
  • The weather is moderate almost the whole year long and with very low rainfall, so the tours are not canceled due to weather conditions.
  • Our tours departure are at the exact established; the customer must comply with being present at the meeting point no later than the departure time specified in the reservation; otherwise, it will be considered as a no-show to the tour, with no chance for a refund or date or time reschedule. We recommend arriving at the meeting point at least 15 minutes before departure time.
  • In the unlikely event that the tour cannot be accomplished for reasons beyond the company due to terrorism, natural disasters, unstable political circumstances or other external events, we offer the following options: rescheduling the date or time of the booked tour; change the chosen tour, or the 100% refund of the reservation. We are not responsible for the expenses you may incur as a result of your reservation, including, but not limited to, mobility, food, lodging, among others.

 

TOUR OVERVIEW:

  • The contracting party is responsible of providing legitimate information during the booking process. The company reserves the right to cancel any reservation if inaccurate information is provided, including (but not exclusively) the name of the participants, identity card numbers, age, country of residence and email address.
  • The company lends the necessary equipment (bicycle and helmet) to the participants of the guided tour to participate in the booked tour.
  • The participant takes full responsibility of the assigned equipment (bicycle and helmet) to participate in the booked guided tour; until it is returned to LIMA BIKE GUIDE S.A.C. If the participant damages the equipment, he/she agrees to compensate LIMA BIKE GUIDE S.A.C. by paying the repairs and/or the necessary replacement components, as a result of the damage caused, excluding regular wear out of the equipment. Should a full replacement of the bicycle be required as a result of the damages, the maximum amount to be indemnified by the participant to the company will be US$ 150.00 US dollars.
  • It is the participant’s responsibility to be in an adequate medical condition and physical shape and have the necessary ability to ride a bicycle in the city, not representing danger to himself/herself or other participants of the guided tour. If the participant is under the effects of alcohol and/or drugs, he/she will not be able to participate in the tour, being excluded from it, without the right to claim compensation.
  • Pregnant women will not be able to participate in the tours for their own and their baby’s safety.
  • If the participant is a minor, a parent or guardian takes full responsibility for the actions of the child during the development of the booked guided tour.
  • The law defines a bicycle as a moving vehicle, subject to all traffic laws, signals, rules and regulations; the participant must comply with such laws, as well as with the rules and regulations issued by the company to accomplish the guided tour with the necessary safety for all the participants, including the mandatory use of the safety helmet while riding the bicycle. Also, the use of mobile telecommunications equipment is forbidden while riding the bicycle.
  • The participants must be respectful and cordial with the guide and other participants, making every effort to follow the safety instructions verbally given by the guide before the tour departure, such as hand signals, always looking at both sides when crossing a street and respecting the traffic signals. The guide can exclude a participant and/or the whole group if their behavior endangers and risks the activity in general, their own physical or any other person’s safety. In that case, the participants cannot claim compensation.

  • The participant accepts the use of the images taken during the tour, for advertising and promotional purposes, by the company in any medium of its choice. The participant also grants the company a perpetual, royalty-free, worldwide and irrevocable license to use such images for advertising and promotional purposes.
  • The participant must consent and allow emergency medical treatment in case of accident and/or medical emergency during the booked guided tour route. LIMA BIKE GUIDE S.A.C. has an insurance policy with the local well renowned insurance company PACÍFICO SEGUROS, that provides coverage to all its participants in case of minor accidents. The policy of PACÍFICO SEGUROS provides the following coverage: If the costs incurred by the emergency medical treatment and/or its derivatives exceed the amounts insured by the PACÍFICO SEGUROS policy, the participant accepts and takes full responsibility for them.

 

PRIVACY POLICY:

  • The personal information provided by the participant to the company is necessary for the correct follow up and payment of your reservation. We understand this data is confidential; therefore, the company assures the adequate processing of the information provided, storing only the contact details and the necessary information for the correct execution of the tour. If we do not have this information at the time of the transaction, we will not be able to complete your reservation or confirm it.
  • For security reasons, the company, under any circumstances, does not store confidential data corresponding to credit and/or debit cards. This information is used exclusively during the booking and payment processes, following all the security and processing protocols established by the payment platforms CULQI (https://culqi.com/legal.html) and PayPal (www.paypal.com), in order to guarantee their maximum confidentiality.

 

LIABILITY DISCLAIMER:

  • The company will not be held responsible for any claim for an accident, personal injury or damage suffered by participants and/or third parties, or expenses incurred to persons and/or property. Also, the company will not be responsible of any loss or damage of the participants personal belongings, being themselves responsible for all their belongings.
  • The company, and any affiliated website, does not assume any responsibility for diseases, criminal acts, labor disputes, governmental actions, acts of war and/or terrorism, weather conditions, defects in any transportation vehicle or for any disaster, accident or any other incidental event, accident or situation beyond its control.
  • The company, through its website (www.limabikeguide.com) and those of its affiliates, verifies and corroborates the information provided to assure its accuracy; however, it does not guarantee that the content and information provided will be free of errors, or that the functionality of the websites will be available uninterruptedly or free of errors.
  • The company will take no responsibility for any participant who infringes any law or regulations of our country.
  • The participant agrees to hold harmless from any liabilities and release LIMA BIKE GUIDE S.A.C., its officers, directors, representatives, employees, associates, guides and participants, of any responsibility for any loss, expenses, damages, claims, demands, rights and causes of action of any type or nature, including reasonable attorneys' fees, as well as any and all claims for negligence or causes of action that may originate and as a result from illness, personal injury, property damage, death or any other damage or injury, included and not included in this document, that may occur during or as a result of his/her participation in the guided tour booked with the company.
  • This agreement is determined by the legal rules established in the Civil Code and others of our country’s legal system, as applicable; also, the parties expressly are subject to the jurisdiction and competence of the judges and courts of the Judicial District of Lima.
  • If any of these conditions of use are considered totally or partially illegal, invalid or otherwise non-enforceable under the valid legislation in our Country, then, as far and within the jurisdiction in which that term is illegal, invalid or non-enforceable, it shall be separated and removed from these conditions of use; the remaining terms or conditions will remain in full force and effect, binding and enforceable.
